This Privacy Policy applies to personal data processed by CERTAINCE GmbH (“CERTAINCE”) in our business, including our websites and other online or offline offerings (“Service” or collectively the “Services”). CERTAINCE enables visitors of its site, certaince.com, to be in control of their personal data. We also provide controls that allow CERTAINCE’s customers to have control over the privacy of personal data that we collect. This Privacy Policy provides information about how CERTAINCE processes and protects this data.

CERTAINCE considers data protection and privacy to be of paramount importance. We never sell personal data and we carry out all processing operations in compliance with the EU General Data Protection Regulation (“GDPR”). What kind of Personal Data is processed and for what purpose?
Usage Data

We process usage data in an aggregated or de-identified form for statistical purposes and to improve our site. When you visit our site we store the name of your internet service provider, the website from which you visited us from, the parts of our site you visit, the date and duration of your visit, and information from the device (device type, operating system, screen resolution, language, country you are located in, and web browser type) you used during your visit. While we process your IP address during the duration of your session, the IP address is truncated and thereby de-identified before it is ever written to disk on our servers. This is done by removing the last octet of your full IP address.

Cookies

CERTAINCE uses cookies to process information including standard internet log information and details of the visitor’s behavioral patterns upon visiting our site. This is done to provide you with a better experience, and to facilitate the use of certain functions. Cookies are small data files transferred onto computers or devices by sites for record-keeping purposes and to enhance functionality on our site. CERTAINCE stores this information in a pseudonymized user profile. CERTAINCE only matches this data with individual contacts if the user agreed to do so.

Cookies are stored on your individual device and you have full control over their use. You may deactivate or restrict the transmission of cookies by changing the settings of your web browser. Cookies that are already stored may be deleted at any time. Should you visit CERTAINCE’s site with cookies deactivated, you may possibly not be able to use all of the functions on our site to the full extent.

Google Analytics

We use Google Analytics to collect information regarding visitor behavior on our website. Google Analytics reads information sent from your browser and stores cookies. The information is used to analyze website visitor behavior and to improve our website. We have made the following data protection settings for Google Analytics:

  • IP anonymisation (truncation of the IP address prior to evaluation);
  • limiting the retention period of event data to 14 months.

The following data is processed by Google Analytics:

  • referrer URL (page last visited);
  • pages viewed (date, time, URL, title, length of stay);
  • downloaded files;
  • clicked links to other websites;
  • if applicable, achievement of certain goals (conversions);
  • technical information: operating system; browser type, version and language; device type, brand, model and resolution;
  • session data from users who are logged into their Google account and have allowed personalized advertising
  • approximate location (country and city, if applicable, based on the anonymised IP address).

We have entered into a data processing agreement with Google Ireland Limited for the use of Google Analytics. In the event that personal data is transferred from Google Ireland Limited to the USA, Google Ireland Limited and Google LLC have concluded standard contractual clauses pursuant to GDPR. Hotjar

We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device’s IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf.

Email and Contact Form

On our site you have the opportunity to contact us to ask us questions, for example via chat or contact form. When doing so, we ask you for your contact information (e.g. name, email address etc.). We use this data solely in connection with answering the queries we receive. If you receive emails from us, we may use certain analytics tools, to capture data such as when you open our email or click on any links or banners our email contains. This data helps us to gauge the effectiveness of our communications and marketing campaigns.

When you sign up for an email newsletter or other content, we may also ask you to provide us with information such as your name, email address and details about your organization. As otherwise detailed in this Privacy Policy, we will solely process this information to provide you with the service you signed up for. You may unsubscribe from receiving content or offers from us at any time.

Access and Disclosure to Third Parties

CERTAINCE does not sell, and has not sold, consumers’ Personal Data at any time. Except as provided below, we also do not share or disclose your Personal Data.

We use a select number of trusted external service providers for certain technical data analysis, processing and/or storage offerings. We only share information with them that is required for the services offered and we contractually bind them to keep any information we share with them as confidential and to process Personal Data only according to our instructions.

Other than the cases mentioned above, we will only pass your data on to third parties without your express consent if we are obliged to do so by statutory law or an instruction by a public authority or court.

The Services may contain links to other websites, and other websites may reference or link to our website or other Services. These other websites are not controlled by CERTAINCE. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen or approve and are not responsible for the privacy practices or content of such other websites or applications. Your Data, Your Rights

You have a right to be informed of Personal Data processed by CERTAINCE, a right to rectification/correction, erasure and restriction of processing. You also have the right to receive from CERTAINCE a structured, common and machine-readable format of Personal Data you provided to us.

We can only identify you via your email address and we can only adhere to your request and provide information if we have Personal Data about you through you having made contact with us directly and/or you using our site and/or service. We cannot provide, rectify or delete any data that we store on behalf of our users or customers.

Duration of Processing

We will store your usage data until such time when you withdraw your consent for us to do so. All other data as specified above will be retained for as long as is necessary for the purpose(s) for which we originally collected it. We may also retain information as required by law.

International Transfers of Personal Data

CERTAINCE’s customer information is stored in the European Union. In some limited cases, customer information may be accessed from, or other data (e.g., e-mail) may be transferred to, the United States or other countries which may have data protection laws that are different from the laws where you live. CERTAINCE has taken appropriate safeguards to require that your Personal Data will remain protected and require our third-party service providers and partners to have appropriate safeguards as well.

Cloudflare

Our website also uses the content delivery network services provided by Cloudflare Inc, 701 Townsend St, San Francisco, CA 94107 (USA).

The content delivery network stores the content of our website on the service provider’s server. The service provider's server distributes this content to you or your browser when you access our website. Cloudflare processes your IP address and DNS log data, for example.

We use Cloudflare for the purpose of defending against attacks such as “DDos or bot attacks” on our website. Furthermore, data processing aims to shorten the loading times of our website so that the content of our pages is made available to you as quickly as possible.

Personal data may be transferred to third countries. Adequate safeguards or other instruments to ensure compliance with the European data protection principles have been implemented for the comprehensive protection of your data in this case.

The legal basis for the use of Cloudflare is Art. 6 para. 1 point f) GDPR due to our legitimate interest in increasing the security and delivery speed of our website. We have entered into a data processing agreement with Cloudflare.

We may revise this Privacy Policy from time to time. The most current version of this Privacy Policy will govern our practices for collecting, processing, and disclosing personal data. We will provide notice of any modifications by posting a written notice on our site.
